Moderate Income Housing 101: Public vs. Private Balance
Affordable housing has become a pressing issue in many cities across the United States. In 2023, the Texas legislature adopted HB 2071, which significantly impacted the ability of private developers and governmental entities to receive ad valorem tax-exemptions for moderate income housing projects through the use of public facility corporation. This session will discuss the implications of the new law and how developers and governmental entities are approaching this market segment since passage of HB 2071. Other legal structures and alternatives to public facility corporations used to develop moderate income housing will also be discussed.
